An Abuja Federal High Court has struck out a motion for stay of execution brought to it by Marcellinus Nlemigbo, a faction Chairman of Progressives Congress (APC) in Imo State.

Chief Marcellinus Nlemigbo who is the chairman backed by Gov. Hope Uzodinma’s administration was brought into power by former National Chairman of the party, Adams Oshiomhole against an existing Daniel Nwafor led administration which was brought to power through a congress during the regime of Sen. Rochas Okorocha.

Justice Musa who presided over the matter on Thursday, July 16, 2020, described the stay of execution motion as mischievous, saying that he had since 2018 given a judgment which forbade any organ of the Party from tampering with the tenure of the duly elected leadership of the Party in Imo State.

The judgment is a two-edged sword and also gives hope to the elected council chairmen whose recent plan to protest the delay in letting them take over their offices was quashed by the police.
