Justic Othman Musa of High Court sitting in Bwari, Abuja, yesterday, restrained Daniel Nwafor from parading himself as the Imo State Chairman of the All Progressives Congress (APC).
Musa gave the order through a motion from a suit filed by Evan Enwerem against APC, its former National Chairman, Adams Oshiomhole and Nwafor, as first, second and third defendants.
The suit was filed in 2018, while judgment was delivered on August 14, 2018.In the motion, the APC sought an order for unconditional stay of execution and enforcement of the judgment delivered on August 14, 2018, pending the hearing and determination of the appeal filed by APC against the ruling.
It also sought an order restraining Nwafor’s agents, messengers, privies, representatives, and/or any persons from acting pursuant to the third defendant as state Chairman of APC, thereby giving effect to the August 14, 2018 judgment, pending the hearing and determination of the appeal against the verdict.
A copy of the court’s enroll order dated July 16, 2018 disclosed the grounds upon which Justice Musa granted the restraining order wherein it noted that the first defendant filed a notice of appeal, which raised questions of territorial, substantive and procedural jurisdiction of the court to entertain the suit.
Justice Musa consequently granted the restraining order because his court reserved the right to preserve the matter in order not to foist a faith accompli on the Court of Appeal or render its eventual decision on the appeal null and void.
Meanwhile, employees of the Imo State University (IMSU) have threatened to embark on strike if the state government failed to clear their outstanding salary arrears.
They said their 675 members including retirees had not been paid their salaries since February 2020, while those who were paid got part payments. The employees, who spoke under the aegis of Joint Action Committee of the Non-Academic Staff Union (NASU), National Association of Academic Technologists (NAAT) and Senior Staff Association of Nigeria University (SSANU), stated this at a media briefing in Owerri.
Chairman of NASU at IMSU, Eugenia John-Anoro, said the situation had foisted untold hardship on the members, resulting in the death of many of them in the last five months.
He added that others could have been those, who were illegally employed without due procedures and documentation for which the Vice Chancellor, Professor Victoria Adaobi Obasi had been queried.
