The the All Progressives Congress (APC) in Imo State has hailed the judgement of the FCT High Court Abuja which struck out an application by a faction of the party loyal to the governor of Imo State, Senator Hope Uzodimma.

The APC faction led by Prince Marcellinus Nlemigbo had approached the court presided over by Justice Othman Musa of the FCT High Court for an order of unconditional stay of execution/enforcement on a judgement delivered by the same court on 14-08-2018 in suit no FCT/HC/BW/CV/103/2018, which barred the APC from tampering or interfering with the tenure of the elected party officials in the state.

But delivering his judgment Thursday, Justice Musa reiterated that his earlier pronouncement which reaffirmed Daniel Nwafor as the authentic chairman of All Progressives Congress (APC) in Imo State still stands.

Reacting to the judgement weekend, the state publicity secretary of the party, Mr. Onwuasoanya Jones, expressed happiness with the ruling and urged other party members to sheathe their swords and allow peace a chance in the party.

According to him, “The Application wasn’t necessary in the first place. It is unfortunate that at a time when the President, who is also the leader of the party, had urged all party members to withdraw their cases from the court, some people are still moving trying to obtain mischievous orders from courts, in clear defiance of the president’s and NEC’s directive.

“This judgement by Justice Musa is a further affirmation of Daniel Nwafor as the only authentic chairman of APC in Imo State, and all executive members elected during the July rescheduled congresses of the party, the only legitimate leadership of the APC in Imo State. We therefore call on all party members to return home and join hands with us as we rebuild the party.”

On the news making the rounds that the Nlemigbo faction got the judge to issue a restraining order against the Daniel Nwafor faction from enforcing the judgement, Onwuasoanya argued that the judgement is already enforced and the order does not vitiate the subsisting judgement which the same court gave about 24 months ago.

“Did the judge expect us not to have begun the enforcement of his ruling for the past 24 months? The judgement has already been enforced and Daniel Nwafor is the only authentic chairman of APC in Imo State.

“Also, by striking out the application for stay of execution, the judge has affirmed that the judgement is already enforced and a request for its stay, in the words of the Judge; “lacks merit.”
