The Court of Appeal sitting in Kano has upheld the judgment of a Jigawa High Court against one Datti Buba, who was prosecuted for the offences of criminal conspiracy, kidnapping, and culpable homicide.

The appellant and two others had on January 2017 criminally conspired, kidnapped and killed two children, Ori Umaru and Umaru, and collected the sum of N3.55 million from the parents of the deceased as ransom but went ahead to kill the children.

It was based on the above that the appellant, together with two others, was on the 18th day of October 2018 arraigned before the lower court, where they pleaded not guilty before the court.

At the end of the trial the second and the third accused persons were discharged whereas the appellant (as the 1st accused person) was found guilty, convicted and sentenced to death by hanging.

The appellant also appealed to the Court of Appeal Kano Division on the grounds that the trial court tried him without territorial jurisdiction.

Justice Usman Musale said the offences of Criminal Conspiracy, Kidnapping, and Culpable Homicide is Punishable with death contrary to Sections 97, 273 and 221 of the Penal Code Law, Cap P3, Laws of Jigawa State 2012.

The Court of Appeal Kano Division in its well-considered judgment, dismissed the appeal in its entirety and affirmed the decision of the trial court.
