The children of the late former Chief of Army Staff (COAS), Lt. Gen. Luka N. Yusuf, and their uncle, Mr Emmanuel Yusuf, have agreed to an out of court settlement.
The children had dragged their uncle before a Kaduna Magistrate Court seeking the recovery of their father’s property in his custody.
Barrister Danjuma Kwajaffa of Messer Hali Chambers, counsel to the claimant, told newsmen in Kaduna at the court premises that the two parties have agreed to an amicable dialogue in order to ensure better understanding in resolving the issue before them.
Barrister Kwajaffa stated that Barrister B. P. Achi, counsel to the defendant approached them to amicably settle the matter out of court, saying that as a result, the case was adjourned to March 17, 2022, for the report of the settlement.
Bilhatu Beauty Yusuf, on behalf of other siblings in Suit No. KDC/734/21, prayed that the court helps them recover their father’s property located at No. 15, Bourmedience Road, Narayi High Cost, Kaduna, in possession of their uncle, Emmanuel Yusuf.
The suit is supported by a claim filed by Barrister D. B. Kwajaffa, who stated that the claimant is entitled to the possession of premises situated at No. 15, Bourmedience Road, Narayi High Cost, Kaduna which the defendant occupied as a licensee and whose license was revoked on 25th October 2021.
According to Barrister Kwajaffa, “The claimant did serve on the defendant a notice in writing of her intention to apply to recover possession of the said premises, by personal service and that, notwithstanding the said notice, the Defendant has refused, failed or neglected to deliver possession of the said premises and still detains the same.”
He explained that the absence of the counsel to Emmanuel Yusuf on 1st February 2022 stalled the court proceedings and was adjourned to 22nd February 2022.
