An Owerri Magistrate Court has denied bail to Imo-based activist Chinonso Uba, also known as Nonsonkwa, following his remand at the Owerri Correctional Facility on multiple charges, including cyberstalking, conspiracy, and character defamation. The court announced its decision on Wednesday, citing a lack of jurisdiction to handle the case or grant bail.

Nonsonkwa’s arrest and charges stem from a petition alleging his involvement in viral videos containing cyberstalking, defamation, and inflammatory remarks. The prosecution, led by N.S. Onwochie, Esq., representing the Commissioner of Police, presented five charges against the activist, including conspiracy, treason, arson, cyberstalking, and defamation.

The defense team, led by C.K. Mgbekonye, Esq., argued for bail based on Section 36(5) of the Nigerian Constitution, which presumes the accused innocent until proven guilty and allows for judicial discretion in granting bail. However, the prosecution opposed the request, pointing to Section 93(1) of the Imo State Administration of Criminal Justice Law, which restricts bail authority to the High Court for such cases.

After reviewing both arguments, the Magistrate Court declined to grant bail and instructed Nonsonkwa’s defense team to seek bail at the High Court. The case is set for further proceedings on November 12, 2024, pending the Director of Public Prosecutions’ report and the transfer of case files.

The Imo State Police Command clarified that Nonsonkwa was arrested following a petition and was not abducted, countering initial public speculation. The case has garnered significant attention, with supporters raising concerns about freedom of expression, while others argue for accountability regarding inflammatory content online.
