Popular social media influencer Martins Otse, widely known as VeryDarkMan (VDM), has moved to appeal a Lagos High Court ruling that ordered him to take down a video and online statements targeting renowned human rights lawyer Femi Falana, SAN, and his son, musician Folarin ‘Falz’ Falana. The controversial video allegedly accused both Falana and his son of accepting N10 million from celebrity crossdresser Idris Okuneye, also known as Bobrisky, to influence a legal case.

Justice Matthias Dawodu’s ruling on October 14, 2024, directed VDM to remove the video and prohibited him from publishing further defamatory statements about the Falanas until the defamation suit is resolved. In response, VDM filed a motion on October 18 requesting permission to appeal, claiming the ruling was based only on the Falanas’ affidavit and lacked his input. He argued that, as an interlocutory order, the appeal requires the court’s permission, stressing that denying this request could lead to a miscarriage of justice.

VDM’s legal motion emphasized the importance of judicial review, stating, “The appellate court’s role in clarifying and, where necessary, correcting trial court decisions is vital in maintaining the integrity of the judicial system.” He argued that his appeal holds significance in ensuring that trial court orders are legally sound and fair to all parties, especially as the allegations he’s contesting revolve around substantial legal and ethical issues.

The influencer contends that a refusal to permit the appeal may result in an outcome that adversely affects not only his rights but also the administration of justice at large. Through his application, he’s requesting the court’s discretionary power to be exercised in a manner that will permit further examination and review of the case by a higher court.

This case has sparked broad online debate, as VDM continues to raise questions about legal ethics and media freedom in Nigeria, while Falana and his son remain focused on defending their reputations against what they view as serious unfounded allegations.
