Chief Cyril C. Nwaka, erstwhile State chairman of the Imo State Chapter of the All Progressives Grand Alliance (APGA) has gone to court to challenge the dissolution of his Executive Committee by Governor Rochas Okorocha and the Victor Umeh/Shinkaffi led National Exco. Twice Chief C.C. Nwaka tried, but only once, he led the party to victory, culminating in the emergence of Owelle Rochas Okorocha as governor of Imo state.
However his tenure was cut short following the emergence of the state governor who preferred to plant a stooge of his as State Chairman. In a suit filed at an Owerri Federal High Court, the lawyer to the dissolved state executive committee of APGA led by Chief C.C. Nwaka is demanding a reversal of the dissolution of the State Executive Committee which he said was illegal, unconstitutional and should be declared null and void. According to the writ of summons deposed to by one Barr. Sylvester Iheakanwa for and on behalf of Chief C.C. Nwaka and others, the Imo State Executive Committee of APGA led by Chief Nwaka was elected on 23rd December, 2010 which action was later ratified alongside that of the National Executives led by Chief Victor Umeh at a well constituted and INEC supervised National Convention of the party in Awka on the 10th of February 2011 for a period of 4years. Chief Nwaka is therefore praying that since Sir Victor Umeh has since been returned to office together with his executives via a court ruling which include Alhaji Shinkafi as National Secretary, the same treatment should apply to him. Chief Nwaka also claims that his tenure should ordinarily expire on the 10th of February, 2015 and that since he was not indicted of any criminal offence or found wanting in the discharge of his duties, as an elected Chairman of APGA, the most reasonable thing to do is to return him as the substantive State Chairman of Imo APGA.
He stated that his previous prayers, entreaties, representation and appeals to the National Executive Committee (NEC) of APGA to see reason to oblige his request fell on deaf ears, hence his resort to the court for justice to prevail. The case comes up in court I of the Federal High Court Owerri on the 19th of November, 2014.
In a motion on Notice, Chief C.C. Nwaka and others are praying for an interlocutory injunction restraining the 7th – 13th defendants led by Barr. Peter Ezeobi either by themselves, agents, servants or privies from parading or holding themselves out as members of the Caretaker Committee of APGA Imo State. They prayed also for an order restraining the Victor Umeh led NEC, from according recognition to any Care-taker Committee of APGA Imo State led by Barr. Peter Ezeobi or as persons entitled to run and manage the affairs of APGA Imo State pending the final determination of the suit.
Chief Nwaka finally accused Barr. Peter Ezeobi, Chief Tony Mgbeahuruike, Chief John Iwuala, Mr. Vicotr Chidi Diala, Dr. David Iwagwu, Gerald Ibegbulam and Enyere Obi both defendants of having connived with Sir. Victor Umeh to threaten to prevent the claimants from continuing to exercise their powers and functions and enjoy their rights and privileges as the elected members of the State Executive Committee of APGA Imo State and that the defendants wish to actualize their threats unless restrained by another order of the Honourable court, from doing so.
